It's also not strictly accurate - I've discussed this with Andre Hedrick
because I was intriuged by an interesting comment somewhere in the kernel
code when you've applied the relevant patches:

I didn't keep the mail from Andre, but basically Abit modified his HPT366
driver to support the 370 and he had to beat them with a shitty stick to get
them to release the source as required - hence "force extraction of GPL".
