I'm not sure. I don't think a EULA can add requirements to the hardware? and
it definitely can't remove your statutory rights.

Dell don't say "you can't sell this to someone without the software that
came with it". Not sure how MS can say that about a Dell machine?

(Bit like saying "You can't sell this car to another person without the
original Pirelli tyres")
