The statement appears to be quite honest in what it is saying. One 
would preliminary injunctions to arise from preliminary hearings no? 
:)

I think the problem possibly is that a careless reader could skim 
through it and come away thinking "forti lost the court case and were 
found to be violating copyright" - to be honest, i think that's what 
i thought initially (but from reading this list).

I'm not sure you can blame the statement for laziness of its readers 
though..
