I havn't followed the discussion (I have one of the dumber 
participants kill filed), but how does stupidity count as an argument 
in favour of software patents? :)

Anyway, software patents can be worked around. Even if we prevent 
them in the EU, they have to be worked around for the USA. See, eg, 
the CDDL's clauses to create a patent-litigation-free zone around 
software it covers.
